Trust & Safety Policy

1. PURPOSE AND SCOPE

This Trust & Safety Policy (“Policy”) sets out the security, quality, and good-conduct rules that apply to the Skich’s (“Skich Store,” “we,” or “us”) Services, to developers who list apps in the Skich Store catalog (“Developers”), and to Skich Store users (“Users”).

This Policy forms part of Skich’s legal framework together with our Terms of Service, Privacy Policy and Distribution Agreement with Developers. In the event of any conflict on matters of content safety, this Policy prevails.

2. GENERAL PRINCIPLES

  • Open Access: Skich Store operates as an open marketplace available to all eligible third-party developers on equal, non-discriminatory terms. Skich Store may curate or limit its catalog based on objective, publicly disclosed criteria.
  • Transparency: moderation rules, content-removal criteria, and appeal procedures are published and enforced consistently and in good faith.
  • Security first: Skich proactively and in good faith works to prevent the distribution of malware, Potentially Harmful Applications (PHAs), and fraudulent or illegal activity.
  • Legal compliance: Skich does not materially violate applicable law (including data-protection laws) and appropriately manages government and legal requests.
  • User protection, including minors: Skich provides parental-control mechanisms (according to our Parental Control Policy) and enforces policies against deceptive and disruptive practices.

3. RESTRICTED CONTENT POLICY

Game App(s) distributed through the Skich Services may not contain, promote, or provide access to:

  • Child sexual abuse material (CSAM) in any form – strictly prohibited. Upon detection, Skich immediately removes the content, suspends the developer account, and reports the material to relevant law enforcement authorities.
  • Other illegal content: promotion of terrorism or extremism, human trafficking, illegal trade in weapons or controlled substances, and unlicensed gambling where prohibited in the relevant jurisdiction.
  • Content that incites hatred or violence based on race, ethnicity, religion, disability, sex, age, sexual orientation, or gender identity.
  • Gratuitous violence, realistic depictions of cruelty, or content that encourages self-harm, suicide, or eating disorders.
  • Adult sexual content, unless the app belongs to a separately verified category with a mandatory 18+ age rating and age-assurance mechanism, where permitted by law.
  • Content promoting separatism or the overthrow of a constitutional order, and content that otherwise violates applicable information-security law.
  • Illegal gambling, financial pyramid schemes, and deceptive investment or lending schemes.

Each app is assigned a content/age rating based on the developer’s declaration.

4. IMPERSONATION POLICY

  • Game App(s), developers, and listings that mislead users about the developer’s identity, brand affiliation, or official status without proper authorization are prohibited.
  • Use of third-party trademarks, logos, app names, icons, or other brand features without the rights holder’s written permission is prohibited.
  • Game App(s) name, icon, and description must accurately reflect the Game App(s)’ functionality and affiliation; clones and fake versions of popular Game App(s) are removed.
  • Developers must verify their identity as part of the organization-registration process with Skich.

5. INTELLECTUAL PROPERTY POLICY

5.1 Developer Requirements

  • Developers must hold written authorization from rights holders and all rights and licenses necessary to distribute the Game App(s) and all content contained in it (media, fonts, libraries, SDKs, trademarks).
  • Submission of a Game App(s) to Skich constitutes a legally binding attestation that such rights exist, as further set out in the Distribution Agreement.

5.2 IP Dispute Process

Skich maintains a publicly accessible process for reporting intellectual-property infringement, modeled on the DMCA process.

Filing a DMCA Notice

To be valid, your DMCA Notice must include:

1.        Identification of the copyrighted work that you claim has been infringed. If your Notice covers multiple works, you may provide a representative list.

2.        Identification of the allegedly infringing material, including a description of where it is located. Your description must be sufficiently detailed to enable us to locate the material. Where possible, include the URL of the webpage where the material appears (if applicable).

3.        Your contact information, including your full legal name, mailing address, telephone number, and, if available, email address.

4.        The following statement:

“I have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law. I represent that the information in this DMCA Notice is accurate and, under penalty of perjury, that I am the owner of the copyright or authorized to act on the copyright owner’s behalf.”

5.        Your electronic or physical signature.

Counter-Notice Procedure

If you believe that material was removed or restricted in error, you may submit a Counter-Notice that includes:

1.        Identification of the material that was removed or disabled and its prior location.

2.        A statement under penalty of perjury that you have a good-faith belief that the material was removed or restricted as a result of mistake or misidentification.

3.        Your contact information, including your full legal name, mailing address, telephone number, and email address.

4.        A statement that you consent to the jurisdiction of the courts where we are located and that you will accept service of process from the party that filed the original DMCA Notice.

5.        Your electronic or physical signature.

Upon receipt of a valid Counter-Notice, we may restore the removed content unless the original complainant initiates legal action within the required timeframe.

Repeat Infringers

We reserve the right to terminate the Agreement and Terms with the Developer and remove all Developer's Apps who are deemed to be repeat infringers or who engage in repeated violations of intellectual property rights.

All DMCA Notices and Counter-Notices should be sent to our Designated Copyright Agent:

Misuse of this process may result in legal consequences. If you are unsure whether material is infringing, consult an attorney before submitting a Notice.

6. PRIVACY, DECEPTION AND DEVICE ABUSE POLICY

6.1 Privacy

  • Any Game App(s) that processes personal data must maintain a published, current privacy policy, linked from the Game App(s)’ store listing.
  • Collection of data not disclosed in the Game App(s)’ privacy policy, and disclosure of data to third parties without appropriate user consent, is prohibited.
  • Game App(s)directed to or used by children must comply with applicable children’s data-protection laws (e.g., COPPA and equivalent regimes in other applicable jurisdictions).

6.2 Deception

  • Deceptive design patterns (“dark patterns”), hidden subscriptions, and misleading statements about price, auto-renewal, or app functionality are prohibited.
  • Advertising or listings containing false claims about functionality, ratings, or reviews (including fake or incentivized reviews) are prohibited.

6.3 Device Abuse

  • Apps that gain unauthorized access to other apps, system functions, sensors, or network resources beyond their disclosed permissions are prohibited.
  • Interference with the operation of Skich’s or any third party’s devices, servers, or networks, including unauthorized access attempts, is prohibited.
  • Game App(s) that covertly consume device resources (battery, bandwidth, processing power) for the benefit of third parties (e.g., hidden cryptomining) are prohibited.

7. ADS POLICY

  • Advertising shown within Game App(s) must not be deceptive, harmful, or designed to mimic system notifications or OS interface elements.
  • Ads that trigger automatic downloads or payments without a clear, affirmative user action are prohibited.
  • Advertising directed at children must comply with applicable requirements for advertising to minors, including a prohibition on personalized advertising based on profiling of minors.
  • Developers must disclose all advertising SDKs and ad networks used in their Game App(s) at submission.

8. USE OF SDKS IN GAME APP(S)

  • Developers must disclose all third-party SDKs included in an Game App(s) (advertising, analytics, payments, push notifications, etc.).
  • Use of SDKs that collect data in ways not disclosed in the Game App(s)’s privacy policy, or that contain known vulnerabilities or malicious functionality, is prohibited.
  • SDKs that violate Sections 6 (Privacy) or 10 (Malware) of this Policy will cause the app to be rejected during review or removed from the catalog.

9. SPAM, FUNCTIONALITY, AND USER EXPERIENCE POLICY

  • Duplicate apps, apps with no meaningful functionality, and listings created solely to manipulate search ranking (keyword stuffing, spam titles) are prohibited.
  • Every Game App(s) must display, at minimum: its name, developer name, description, version, size, list of requested permissions, applicable legal disclosures, and developer contact information.
  • Game App(s) must be functional at the time of publication and must not contain critical defects that block its core functionality.
  • Game App(s) installation and any change of account ownership occur only with the user’s explicit consent; users are given clear control over automatic or manual updates and can uninstall Game App(s) without obstruction.
  • Mass automated messaging, install/review fraud, and the use of bots to artificially inflate Game App(s) metrics are prohibited.

10. MALWARE POLICY

  • Skich proactively works to prevent the distribution of malware and Potentially Harmful Applications (PHAs), including spyware, ransomware, trojans, hidden backdoors, and apps that exploit Android OS vulnerabilities.
  • All submitted APKs undergo automated malicious-code scanning prior to publication; apps flagged as suspicious are escalated for manual review.
  • Upon detection of a malicious Game App(s), it is immediately blocked or removed, affected users are notified, and the developer’s account is reviewed for further violations.

11. MOBILE UNWANTED SOFTWARE (MUWS) POLICY

  • Game App(s) that alter device behavior or the behavior of other Game App(s) without the user’s explicit, informed consent (e.g., browser homepage hijacking, covert installation of additional apps, intrusive out-of-context advertising) are prohibited.
  • Game App(s) that prevent their own uninstallation or that of competing Game App(s), or that hide their processes or icons from the user, are prohibited.
  • Game App(s) that change device system settings (network, DNS, device-administrator rights) without a direct user request are prohibited.

12. LEGAL COMPLIANCE AND GOVERNMENT REQUESTS

  • Skich Store does not materially violate applicable data-protection and consumer-protection laws and responds promptly to lawful requests from government and law-enforcement authorities.
  • Government requests and legal notices, including reports of illegal content, are submitted to support@skich.app.
  • Skich publishes a transparent process for removing illegal content – including PHAs, fraudulent activity, and content that endangers children – at https://skich.app/terms and https://developer.skich.store/Skich_DistributionAgreement.pdf.

This Policy may be amended and (or) modified at any time of the Services operation. In this case, a new version of the Policy and date of its adoption will be published in the Services. If you disagree with amendments and/or additions hereto, please do not use our Services.
